Good news for pubs-at last!

Pubs and other venues which pay licence fees to PPL (Phonographic Performance Limited) for playing music are due a substantial repayment following a High Court ruling last week.

It is estimated that they have been overcharged to the tune of £10 million since 2005, and it should result in savings of over £3 million a year to the industry.

The High Court upheld a ruling by the Copyright Tribunal last November, and it leads the way to pubs being able to claim repayments. Full details of how to claim are due shortly. This will be a welcome boost to the trade at a time when the bottom line will be challenged by the rates increases due in April.

As a hotel we pay both PPL and PPS do we also have a claim for repayment?...

Just wondered, as a company we have been paying both PPL and PRS for the last 15 years, but sold up last June, so are we elligable to claim ? ...

The ruling only applies to PPLs. PPL say on their website that they will be writing to everyone who will benefit by the refund, but you can also call them on 0207 927 1440 to check the position. All current holders of PPLs should have received letters by now.If you have sold the premises your ability to claim a refund depends upon whatever arrangements you had with the people you sold to if you sold as a going concern. If you simply closed the premises I do not see why you should not be able to claim a refund, but I suggest you telephone PPL. There is useful guidance on the reclaim procedure on The British Beer & Pub Association website. ...
